My name is Atty. Albert Jerome F. Babaylan,
I would like to request a list of foreign nationals that were placed under the blacklist of the Bureau of Immigration from 2020 until 2022.
I am conducting research on immigration statistics to better understand the trends and behaviors of foreign nationals in terms of their visa status as well as to determine if there are any common reasons for being issued a blacklist order. This is conducted to help not only clients but may also be beneficial to the Bureau of Immigration.

Thank you for your request dated Nov 23, 2022 01:44:02 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
You asked for Foreign Nationals who were included in Blacklist from 2020, 2021 and 2022.
The BI regrets to inform you that it cannot issue such information in compliance with RA 10173 (Data Privacy Act of 2012), Secs. 3 and 13, to wit:

(l) Sensitive personal information refers to personal information:
(1) About an individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations;
(2) About an individual’s health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings;
(3) Issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and…

SEC. 13. Sensitive Personal Information and Privileged Information. – The processing of sensitive personal information and privileged information shall be prohibited, except in the following cases:
(a) The data subject has given his or her consent, specific to the purpose prior to the processing, or in the case of privileged information, all parties to the exchange have given their consent prior to processing;

(f) The processing concerns such personal information as is necessary for the protection of lawful rights and interests of natural or legal persons in court proceedings, or the establishment, exercise or defense of legal claims, or when provided to government or public authority.
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to www.immigration.gov.ph Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter.
