Hi Good day!

I am currently doing my legal research and is interested to know the answers with the following questions:

1.) If the imposed to simple immigration violations as mentioned in the Sec. 2 SBM-2015-012, particularly on overstaying, still applies if the reason for non-renewal or extension of the visa is due to a hold departure order?

2.) Does an resident-alien/9g alien initially charged with HDO but was lifted afterwards, need to leave the country first to re-new such visa.
