Foreigners are in a situation where we must accept the conditions and treatment of the companies that processed this visa for us without having the possibility of changing to another job for almost a year already.

When we request a downgrade of the 47a2 visa, an OTL (Order to leave) will be send and Bureau of Immigration did not provide any logical alternative during the pandemic that will help us to be able to downgrade this visa without the need to leave the country (with the travel ban we will not be able to enter again).

Greetings!

Thank you for your request dated Dec 16, 2020 08:37:49 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

I am truly sorry for the delayed response.  We are swamped with letters brought about by the nationwide lock-down and we got lost track of your letter due to the volume of correspondence. Please be informed that, as a rule ( Operation Order SBM-2014-013), an application for downgrading of 47(a)2/PEZA visa entails an order to leave (OTL) upon approval.  There are two (2) exceptions nevertheless: (i) When applying for an immigrant visa i.e., 13a visa; and (ii) When working for the same company. 

However, applicants with OTL may submit a  Motion for Reconsideration (MR) to the Commissioner to set aside the order to leave based on humanitarian and/or meritorious grounds. I hope that we have addressed your concern.  Kindly accept my sincere apologies for the delay in replying to your e-mail and I thank you for your patience.
