June 14, 2021 Dear Jerric, Greetings! Thank you for your request dated Jun 10, 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Travel Clearance. Response to your request We were able to determine that this particular information is already available online and therefore cannot be counted as a valid FOI request. You may retrieve your requested information from BI website immigration.gov.ph or you may click the link http://www.immigration.gov.ph/images/Advisory/2021/03_Mar/05/002.jpg for additional requirement for Filipinos Traveling Abroad. Thus, regarding your inquiry on the rules of departure you may download the standing order of departure formalities by clicking the link http://www.immigration.gov.ph/images/ImmigrationLaw/2017_Feb/13_LML-M-03-A12_001.pdf . Further, for DOST Scholars who has: 1. Dismissed Watchlist Order (WLO) but still appearing in the Bureau's derogatory record, must secure Lifting of the same to the BI by personally filing or thru an authorized representative (with Special Power of Appoint) with proof that and/or document from DOST requesting the dismissal of the said WLO; and 2. Existing WLO, must secure Allow Departure Order from the BI by personally filing or thru an authorized representative (with Special Power of Appoint) with proof that and/or document from DOST allowing the traveler to depart/leave for a certain period despite the existing of the said WLO. To inquire if there is an existing derogatory record and/or to secure BI Clearance Certificate as proof that the passenger no longer has existing derogatory record, you may personally file your request to the BI Main office. Because Derogatory Record consists of personal information and it is protected under the Data Privacy Act of 2012, comprehensive and strict privacy legislation “to protect the fundamental human right of privacy, of communication while ensuring free flow of information to promote innovation and growth.” Thus, the Bureau could not disclose the subject information thru online. It can only be disclosed to the owner of the information, to third party if with Special Power of Attorney of the owner of the Data or with court order. Your right to request a review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the BI Commissioner, JAIME H.
