Hello. My US-registered company is sponsoring me for a business conference in Bulgaria. I will be finally meeting my colleagues who are working from different places around the globe. I am happy with the company for more than a year already.

Questions:
1.  Is the Affidavit of Support and Undertaking a constitutional requirement for ALL FILIPINOS who are flying out? 
2. Is there no other way for me to prove that I am not being trafficked and it is my voluntary consent to go there?
3. How is my private business trip in Bulgaria a national security, public safety, or public health threat?

Your Request

You asked for Constitutional Right to Travel over Circular 036-2015 Inter-Agency Council Against Trafficking IACAT.

Response to Request

I enclose a copy of the DOJ IACAT Revised Guidelines on Departure Formalities for International Bound Passengers of the information you requested.

Under the DOJ guidelines, Affidavit of Support and Undertaking is not a requirement to ALL Filipinos traveling outbound. This specific requirement shall be required if the passenger is traveling through a sponsor. A passenger found to be misrepresenting the purpose of his/her travel as a tourist shall not be cleared for departure. Kindly refer to the attached guidelines for your reference.

Please note that we are only able to provide some of the information you have requested as the question of constitutionality of a rule or a law is within the ambit of the Judiciary. The Executive Branch to which the Bureau of Immigration belongs, can only implement laws enacted by Congress, and the rules and regulations duly signed and approved by authorized officials of our Agency. 

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Norman G. Tansingco at xinfo@immigration.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter.
