I am Rachel Mae M. San Diego, a fourth year Law student of Bulacan State University. And as fulfillment of the requirements of the requirements of the Juris Doctor program, I am undertaking a thesis on the topic of “Removal of persons afflicted with epilepsy from the provisions of the Philippine Immigration Act pf 1940 as aliens excluded from entry into the Philippines “

Such subject matter requires information only your humble pfficr may provides, specifically on the data/statistic of epileptics that were refused to  enter Philippines and all other necessary information

Thank you for your request dated Sep 24, 2018 01:33:15 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for Statistic/data of epileptics excluded entry into the Philippines as per Immigration Act of 1940.

Response to Request

Your FOI request is approved. 

Please be informed that a foreign natinal with epilepsy is one of the excludable subjects under Section 29(a)(2) of the Philippine Immigration Law (PIA). Please take note that the PIA has been a valid law since 1940.

From among the several grounds for exclusion provided by the PIA, our Immigration Officers consider the totality of all the factors and circumstances of the specific foreign national seeking entry in the country.

Based on our existing records, we have not excluded subjects with epilepsy or on the sole basis of their medical condition alone.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Commissioner Jaime H. Morente, Bureau of Immigration. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
