Good day,

I would like to inquire about the timeline of processing for a Motion For Reconsideration regarding the removal or extension of an Order to Leave / OTL issued to a foreign national after the downgrading of Visa. While the MR is being processed, will the OTL also be suspended in the meantime? The purpose behind the MR is due to medical reasons, hence the request to extend the 9(a) Visa validity for a few days after the OTL, as the foreigner is recovering from surgery. Thank you.

Thank you for your request dated Apr 24, 2023 11:18:04 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for the following information:

1.  The processing time of the Motion for Reconsideration of the Downgrading of Visa with Order to Leave; and
2. Whether the Order to Leave is suspended while your Motion for Reconsideration is pending.

Response to Request

Your FOI request is approved. 

Regarding the processing time, please note that a Motion for Reconsideration is a complex transaction. Thus, it would take 23 working days or three weeks upon submission of the complete requirements.  This aligns with the provision of ARTA Law or R.A.11032.

After submitting the complete requirements for the Motion for Reconsideration of the Downgrading of Visa with Order to Leave, the period to which the subject is Order to Leave is suspended pending the resolution of the MR.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Commissioner Norman G. Tansingco. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.
