Hi. Can NEECO 1 be sued for just compensation if there's an instance that it constructed an electric lines/posts to any private property because according to PD269, one of its power is eminent domain? And should we implead NEA too? Legal basis.

Hi. This is a follow up message. 

Can NEECO 1 be sued for just compensation in view of its occupation of a private property without the consent of the owners thereof? Said occupation was made under its eminent domain power under PD 629.

Thank you for your request dated Sep 09, 2023 12:15:23 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for NEECO 1 - JUST COMPENSATION.

Yes, you can sue NEECO I for just compensation. However, NEA cannot be impede because NEECO I is a private entity and NEA is only supervisory agency to all electric cooperatives pursuant to Presidential Decree No. 269, as amended by Republic Act No. 10531.
