Hello. Good day!

This is Rogieline Delfin from Anilao, Iloilo. I've been receiving threats and harassment from the different agents of online lending app which is "PesoCow". This online lending company wants me to pay a loan of which out of my consent. I'm still on the process of filling up then suddenly in my surprise I already have a loan needed to pay. I immediately contacted their customer service and it tells me that they will close my account once I sent back the money they disburse. Many agents from their company is messaging me with threats even though I already sent back the money.

You seek help due to unauthorized access and alleged harassment of your contacts by an online lending app.

Response to your request

While we aim to provide information whenever possible, in this instance, your inquiry is not a valid FOI request but a complaint which should follow our citizen’s charter.

Executive Order No. 2 s. 2016 which provides for guidelines on the full public disclosure in the public service covers only access to information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development.

In this regard, complaints and request for clarification on data privacy violation should follow the guidelines provided in the citizen’s charter our agency, which you may access here: https://www.privacy.gov.ph/citizens-charter/filing-a-complaint/

Nonetheless, to assist you with your concern, we have forwarded your inquiry, name, and email address to our Public Information and Assistance Division (info@privacy.gov.ph) for the drafting of response.

You may expect our written response within 3-7 working days. However, if the concerned office determines that this may be a subject of an advisory opinion, the same will be released to you not later than 20 working days, unless the complexity and novelty of the subject matter require a longer period of time for further evaluation. 

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Privacy Commissioner and Chairman John Henry Du Naga at info@privacy.gov.ph. Your review request should explain why you are dissatisfied with this response and should be made within 15 calendar days from the date you received this letter. We will complete the review and tell you the result within 30 calendar days from the date we receive your review request.
