I would like to request a copy of my BIR Form 2316. I am required by my new employer to submit a copy of this form before my training starts.

Dear Ms. Barlis,

I refer to my letter of Sep 26, 2021 10:57:48 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Form 2316 Copy.

In order for us to work further on your request, please indicate your employer’s TIN, RDO no., business name & address. and email it at ana.marie.du@bir.gov.ph as these are sensitive information.

Kindly clarify from your new employer if what they are asking from you is for 2020 as maybe what they were asking from you is the BIR 2316 for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.

Furthermore, please be informed that your BIR Form 2316 should have been issued to you by your previous employer, If there is any, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 20, 2021 04:52:41 AM, your request will be closed.
