Dear Mr. Geron,

I refer to my letter of Dec 20, 2021 03:20:40 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR.

In order for us to properly endorse and work further on your request, kindly clarify what exactly are you requesting, is it ITR or BIR Form 2316? 

If you are requesting for BIR Form 2316, kindly provide us your employer’s TIN, RDO no., business name & address, and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information.

On the other hand, If you are requesting for ITR, kindly provide us the following details and email the same:
- What ITR form did you file for 2010=2020?
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file.

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 14, 2022 08:30:02 AM, your request will be closed.

Your Request

You asked for ITR.

Response to Request

Your FOI request is approved. I enclose a copy of your 2012 ITR only because this is only income tax return you have filed of the information you requested.

Please note that we are only able to provide some of the information you have requested for as our system have shown that you only filed your 2012 income tax return. Unfortunately, there were no attached form 2316. If you need a certified copy please go tour office and have it stamped certified through copy in our collection section of RDO 47 and pay certication fee of P100 using BIR form 0605 in authorized agent banks of rdo 47. 

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Ana Marie Due with email ana,marie.du@bir.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
