Dear Shellane Gomez,

I refer to my letter of Feb 19, 2022 10:14:16 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR 2316.

In order for us to properly endorse and work further on your request, we need for you to clarify which of the two are you requesting as we have different policies, manner and venue of filing of these two documents. 

If you are asking for ITR, kindly provide us with the following details from 2007-2016 :
-What ITR form did you file? 
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. 

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC

On the other hand, for BIR form 2316, kindly email us your employer's TIN, RDO name & business address, and for CY 20110-2019.

Please be reminded that details/information we asked are  confidential information that is bounded by the Data Privacy Act of 2012, thus, you may just email them at ana.marie.du@bir.gov.ph.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 16, 2022 04:56:51 AM, your request will be closed.

Dear Shellane Gomez,

I refer to my letter of Feb 19, 2022 10:14:16 PM; about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR 2316.

Our response to your request is due on Mar 11, 2022 10:14:16 PM. Unfortunately, it is taking longer than expected to deal with your request since the form 2316 you are requesting covers taxable year 2014 long years ago and we need to retrieve for the Certification as "Annex F" showing proof that you are included in the list of employees qualified for substituted filing for the Income Tax Returns pursuant to Section 2.83.4 of RR No. 2-98.

However, we would suggest if you could send the aforementioned Annex F for speedy retrieval, we would be gladly appreciate. 

We apologize for this delay but have applied for an extension so we could work further on your request. We hope to be able to send you a response on or before Apr 08, 2022 10:14:16 PM.

Dear Shellane Gomez,

Greetings!

Thank you for your request dated Feb 19, 2022 10:14:16 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your are requesting for your consolidated ITR 2316 for the period November 1, 2007 to May 30, 2016. 

As response, we requested you to provide us the received Certification as "Annex F" proving that you are included in the list of employees qualified for substituted filing for the Income Tax Returns as submitted by your employer pursuant to Section 2.83.4 of RR No. 2-98. As reference, said certification will make our retrieval more easier. 

Further, We discussed this matter over the phone explaining that this Certificate "Annex F" is essential to our process of retrieving your 2316 on the premise that the period you are requesting is long years ago and the files have been archived on our storage facilities.  

However, during this conversation you told us that you are uninterested in pursuing the request anymore for some personal reasons.

Your FOI request is approved.

Please note that we are only able to provide the information you have requested for as long as you have furnished us  the Certification "Annex F".

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Revenue District Officer using contact number 8863-40-74. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
