Dear Ms. Vergara:

I refer to my letter of Nov 06, 2023 08:08:10 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.

After careful consideration, you are to coordinate with your EMPLOYER (s) as the same is Mandated to Issue the BIR Form No. 2316 for the Calendar Year (s) 2014 to 2023 (in case your employment with the company has been terminated before the end of this year), pursuant to Section 83 of the 1997 Tax Code and Section 2 [2.83.1] of Revenue Regulations (RR) No. 3-2002, respectively. 

The EMPLOYER shall furnish each Employee/s with the Original Copies of BIR Form No. 2316 as Proof that your Taxes were Withheld and this will serve as your Income Tax Return (ITR).  EMPLOYER is required to issue BIR Form No. 2316 on or before January 31 of Every Year and On the Day the Last Payment of Compensation is Paid.

As an added information, the available records of documents in the Revenue District Offices (RDOs) are from Calendar Year (s) 2020 to 2022.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jan 29, 2024 01:54:50 AM, your request will be closed.
