Dear Ms. Corpuz:

I refer to my letter of Nov 17, 2022 11:01:43 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In relation to your request lodged through the eFOI Portal, regarding your BIR Form 2316 for the Calendar Year 2020-2021, upon verification in our database, no record has been found pertaining to your former Employer's Taxpayer Identification Number (TIN). 

It would be helpful and highly appreciated  if the TIN is provided because your request will be forwarded to the concerned Revenue District Office (RDO) where your employer (during the coverage period of 2020-2021) submits their
employees’ BIR Form 2316 and where your former Employer is registered. 

A Certification of the Transmittal from your Former Company that You are included in the 'Annex F' received by the BIR-Revenue District Office will be required from you ( "Annex F" from the company duly stamped by the BIR in which your name is included in the transmittal).

On the other hand, may we then suggest that you refer directly to your former employer as the said document  was originally from the company and should have been provided to you after it has been filed in the BIR. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

Greetings!

Thank you for your request dated Nov 17, 2022 11:01:43 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for BIR Form 2316.

Response to your request

We called your mobile number today, February 17, to validate your existing eFOI request and you informed us of the following:

1. You have resigned from the company and has an ongoing work dispute filed at the Department of Labor and Employment (DOLE);
2. No BIR Form 2316 was issued to you;

In this regard, you may verify with the compliance section of RDO 44-Taguig/Pateros (as this was the address you have provided in your email) on whether or not the said company (Everise) has filed your Income Tax Return/BIR Form 2316 (in your behalf) together with Annex F of Revenue Regulations No. 11-2018.

We relay to the Taxpayer Identification Number (TIN) which is not provided as the request for a copy of BIR Form 2316 shall be made/endorsed at the Head Office of the Company where registered.
