Dear Ms. Falame:

Greetings!

Thank you for your request dated Nov 04, 2022 12:40:39 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for Income Tax Return (ITR).

Response to Request

Please be informed, that BIR Form 2316 (Certificate of Compensation Payment/Tax Withheld) is considered as your Annual Income Tax Return (ITR) for individuals earning Purely Compensation Income. Your Employer are supposed to provide you with this BIR Form “Na Dapat Po Ibibigay Ito Sa Mga Empleyado” every year before January of the following year.

Since, you have two (2) employers in a Calendar Year, you should submit BIR Form 2316 from your previous employer to your new employer for consolidation and computation of your withholding tax remittances to determine if you still have tax due payable, if any. Further, your new employer will submit the consolidated BIR Form 2316 to the Revenue District Office (RDO) where they are registered.

Just in case, you are supposed to file your Annual Income Tax Return (using BIR Form 1700) through eBIR Forms (Apps downloadable at the BIR website, www.bir.gov.ph), attached and consolidate your 2316 from your companies just in case you have not submitted a copy of your BIR Form 2316 from your previous employer (covering period Jan-October 2021).

Thank you.

Respectfully yours,

FOI Officer
