Dear Sir/Madam,

Hope you are doing well.

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not able to provide me with my BIR 2316 because the company is already closed. I worked from Feb2022 to May 2023.

Dear Ms. Camaquin:

I refer to my letter of Jun 08, 2023 09:22:45 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for a copy of BIR Form 2316.

In reply,  kindly provide the following details:

> Name of your Employer for Calendar Year 2022;
> TIN of your Employer;
> Registered Address of your Employer;
> Your Date of Birth;
> Your Address;
> Your TIN; and
> Your contact number (mobile no.) in case we need to call you for further 
    information.

Your request will be endorsed to the Revenue District Office (RDO) having jurisdiction or where your former employer is registered for consideration purpose and if your employer has been fully compliant with their tax obligation and has submitted scanned copies of BIR Form No. 2316 of their employees last February 28, 2023.

BIR Form No. 2316 should have been provided to you by your employer as they are obligated to furnish their employees' a copy thereof as a proof of taxes withheld which shall serve as your Annual Income Tax Return (AITR) per Revenue Regulation 2-98, as amended. ,

For BIR Form No. 2316 for the Calendar Year 2023, the RDO does not have yet a copy of the document as this was due for submission by your former employer on February 28, 2024. Or if they have submitted the aforesaid form before the closure of their business operation.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Aug 31, 2023 04:43:53 AM, your request will be closed.
