Dear Mr. Castro,

I refer to my letter of Dec 22, 2021 10:46:55 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form  No. 2316.

In order for us to properly endorse your request to the concerned office, we need more information from you regarding your query.  Kindly email the TIN, name & business address of your employer at ana.marie.du@bir.gov.ph.

However, if you know where you filed your BIR Form 2316 , you may directly request it to the concerned RDO for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

On the other hand, if you need this requirement for employment purposes, you may just directly request the BIR Form 2316 from your previous employer as your new employer will take into consideration your income from your previous employment for them to do the year-end adjustment and your tax liability will be based on your total income for the year. 

It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 16, 2022 05:31:01 AM, your request will be closed.
