Dear Ms. Dela Rosa:
I refer to my letter of Apr 13, 2023 11:55:10 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for a copies of your Income Tax Return (ITR) and/or BIR Form 2316 for Calendar Year 2014 to 2021.
In order to identify or locate the requested information, we are seeking for further clarification specifically:
1. Did you have a Registered Business between the period January 1, 2014 to December 31, 2021? Or were you an Individual Earning on Purely Compensation Income from the period January 1, 2014 to December 31, 2021?
2. If Employed, kindly provide the Complete Name of your Employer's, Employer’s TIN and Employer’s Registered Address for the period January 1, 2014 to December 31, 2021?
3. Withstanding your answer to the first and second query, did you file an ITR for the cited period?
If you are an Employee for the period January 1, 2014 to December 31, 2021, your EMPLOYER/s is required to issue a copy of your BIR Form 2316 for Calendar Year/s 2014 to 2021 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).
Please be informed also that BIR Form 2316 issued for Calendar Year/s 2014 to 2018 are already already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008). Hence, you may ask your previous employer/s for the copy/ies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
