I refer to my letter of Nov 06, 2021 11:41:29 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.
Response to your request
Kindly clarify from your new employer if what they are asking from you is the BIR form 2316 for 20112 as maybe what they were asking is the BIR Form 2316 for the current year?
Please be informed that your new employer will ask you for the BIR Form 2316 for the current year for them to do the year-end adjustment as they will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.
Moreover, for ITR 2009- 2011, please be informed of the below procedure in ITR Filing prior to 2013:
1. The employers provide for the BIR Form 2316 to their employees after the year ends; and
2. Subsequently, all employees are required to file their returns to the RDOs where they are registered, with tax due or zero/no payment, hence, we cannot provide a copy of your BIR 2316 if this was not filed.
The mandatory submission of Employees’ BIR Form 2316 in lieu of the Income Tax Return (ITR), “who are qualified for substituted filing” by the employers started the year 2013, reference-based in RR No. 11-2013 and further amended by RR 2-2015.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jan 28, 2022, 09:35:09 PM, your request will be closed.

Good day, thank you very much for your response.
I was employed last 2012-2014 and 2016 but only for contractual positions. New employer will most likely ask for proof of previous employment (like COE), but since I was only contractual, I do not have certificates of employment to prove this. I also do not have a copy of the project contract, because the funding agency only provides a copy of the contract to my project leader (my project leader never gave me a copy, I didn't request for it since I didn't know I'm gonna need it in the future). Thus, my only proof of previous employment would be the 2316.
I do have my copies for ITRs last 2013, 2014, and 2016; but I don't have 2012. This is why I'm requesting for a copy of my 2012 ITR.
