Dear Paul Jeremiah Go:

I refer to my letter of Jul 28, 2022 08:34:31 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return (ITR) and/or BIR Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as Substitute  Income Tax Return for Taxable Year/s 2012, 2016 and 2019, kindly send us the Name of your Employer/s for the covering period/s, Business Address of your Employer/s and Employer/s Taxpayer Identification Number (TIN) and email it at sherry.ann.arcita@bir.gov.ph indicate in the subject tracking number #BIR-463728410403 to respond. We will coordinate and endorse your request to the Revenue District Office (RDO) having jurisdiction over the place of your Employer/s and where they submits their reports.

Please be informed also, that per record/files of the district office/s for the aforementioned years most likely were already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, retention period of withholding tax certificates. It will be practical and appropriate for you to refer to your employer and ask for the said copies where it actually originated.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 21, 2022 12:44:39 AM, your request will be closed.

Aboitiz Jebsen Company Inc. is under the Jurisdiction of RDO 47. For the year 2012, they did not submit a list of their employees together with the copy of 2316 who availed of substituted filing. We also checked our database and found out that you did not file any income tax returns.
