Dear Jonathan Bautista:

I refer to my letter of Jul 19, 2022 07:43:26 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return (ITR) or BIR Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as Substitute  Income Tax Return for Taxable Year/s 01-01-2012 to 12-31-2015, kindly send us the Name of your Employer/s for the covering period, Business Address of your Employer/s and Employer/s Taxpayer Identification Number (TIN). We will try to coordinate and endorse your request to the Revenue District Office (RDO) having jurisdiction over the place of your Employer/s and where they submits their reports. Kindly email the needed information at sherry.ann.arcita@bir.gov.ph and indicate in the subject tracking number #BIR-468122522802, to respond.

Please be informed also, that per record/files of the district office for the aforementioned years most likely were already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular No. 73-2008 (Retention Period of Withholding Tax Certificates) it will be practical and appropriate for you to refer to your employer and ask for the said copies where it actually originated.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 11, 2022 06:13:04 AM, your request will be closed.

You asked for Income Tax Return which we have already provided and was already sent to the email address indicated.

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to ltad@bir.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
