I refer to my letter of Feb 14, 2022 10:58:44 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return Report.
In order for us to properly endorse and work further on your request, we need more information from you regarding your query. Kindly provide us with the following details and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information
-What ITR form did you file?
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online)
Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file.
However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 09, 2022 04:29:51 AM, your request will be closed.

Hi Ana,
Thank you for the clarification.
1. What ITR Form did you file? I didn't file the ITR it is my employer who does. I just want to verify if the withholding tax that has been deducted to me to my payslip is accurate with my ITR for Y2020.
2. Where did I file my ITR or RDO registered? Not sure about this as my previous employer the business area is in QC and the other is in Fort Bonifacio Taguig. However, I am sure that I am currently registered in RDO 27.
3. Tax Return Confirmation Receipt? I don't have this as my employer is the one who file it on behalf of me. On our we didn't get receive a copy of our ITR for Y2020.

Hi Ma'am Ana,
Thank you for the information.
I agree, However, I want to know more if the payment of my employer to BIR did not exceed the allocated tax table that I am currently at.
That's why I need the ITR Report from BIR if we have a tax refund or not, as this is the only way for us to compute the tax paid by the employer versus charge by the BIR to us based on the train law tax table.

Hi ma'am!
I f you just want to verify if the withholding taxes deducted from you was correct, you just have to reconcile this to the Bir form 2316 that should have been issued to you by your employer.
Request from them a copy as it is mandated by law that they should issue the
2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.
Furthermore, ITR should be filed by you, not by your employer.

As mandated by law, your employer is required to remit the correct amount of tax that should be deducted from your taxable net income, hence, we require also that employee should sign in the BIR form 2316 before it will be filed to the BIR as you need to check if what has been reported there are all correct, if you conformed, then you should sign in the BIR Form 2316 that has been issued to you, now if you see discrepancies, let them know so this will be corrected. If in case there is an excess in withholding tax over your Income tax due, your employer should refund the excess withholding to you not the BIR.

However, you may directly request the BIR Form 2316 for CY 2021 from your employer as it is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made. They are also the main source of this document and it should be signed by you before submitting the same the Revenue District Office, hence, your are supposed to have this form by now.
