Dear Ms. Viola:

I refer to my letter of Jun 30, 2023 12:51:14 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form No. 2316.

In reply, please be informed that your request for a copies of your BIR Form No. 2316 for CY 2012 to 2023 can be obtained through your EMPLOYERs as they are obligated to furnish every employee a copy of the aforesaid form as a proof of your taxes withheld which shall serve as your Annual Income Tax Return  according to Revenue Regulation 2-98, as amended.

The employer shall prepare BIR Form No. 2316 in triplicate, which shall be distributed as follows:

(1)	Original – Employee’s copy;
(2)	Duplicate – BIR’s copy; and
(3)	Triplicate- Employer’s copy which shall be retained for a period of ten (10) years.”

Kindly coordinate with your employers if you have not received a copy of your BIR Form No. 2316 for CY 2012 to 2023.
