I would like to get a copy of my ITRs since 2011.

Dear Ms. Colico:

I refer to my letter of Jun 30, 2023 12:30:14 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for a copy of Income Tax Return and/or BIR Form No. 2316 from 2011 to 2023.

In reply, please be informed that your request for a copies of your BIR Form No. 2316 for CY 2012 to 2023 can be obtained through your EMPLOYERs as they are obligated to furnish every employee a copy of the aforesaid form as a proof of your taxes withheld which shall serve as your Annual Income Tax Return  according to Revenue Regulation 2-98, as amended.

The employer shall prepare BIR Form No. 2316 in triplicate, which shall be distributed as follows:

(1)	Original – Employee’s copy;
(2)	Duplicate – BIR’s copy; and
(3)	Triplicate- Employer’s copy which shall be retained for a period of ten (10) years.”

Kindly coordinate with your employers if you have not received a copy of your BIR Form No. 2316 for CY 2011 to 2023.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 22, 2023 01:10:29 AM, your request will be closed.

If unfortunately I am unable to contact my previous employer and lost the copies of my ITR documents, how would I be able to get a copy of it from BIR?

Response to your request

Per your email dated July 3, 2023, you were able to retrieved your copies of BIR Form No. 2316 for CY 2015 to 2022. Thus, you wont be needing our assistance since the records of the RDO has a retention period.
