Dear Mr. Santos,

I refer to my letter of Jun 01, 2023 07:10:15 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form 2316.

In reply, if you are an Employee for the period of 2022 to 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2022 to 2023 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022 to 2023 (in case your employment with them has been terminated).

For other concern, kindly email sherry.ann.arcita@bir.gov.ph and indicate in the subject email ticket number #BIR-519316739588, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Aug 25, 2023 12:38:56 AM, your request will be closed.

Your Request

You asked for Income Tax Return and/or BIR Form 2316.

Response to Request

Please be informed that you have been provided by your employer for a copy of your BIR Form 2316 for Calendar Year (CY) 2022, which was sent to my BIR email today ( June 5, 2023).

On your Other Request for BIR Form 2316 for CY 2023, that can be requested directly to your employer, as the BIR RDO gets a hold of the document upon submission of your employer to the district on February 28, 2024.
