Hi, kindly requesting a copy of my BIR Form 2316 for the taxable income period of 1/1/22 - 12/31/22 for visa application purposes. I resigned from my last company last 12/31/22 (effective 1/1/23) but the company still has not issued me by BIR 2316 form. 

I am currently applying for a rush visa which I need for my current work as we have a trip next month.

Hoping for your kind consideration and help with this urgent request.

Greetings!

Thank you for your request dated Feb 16, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Urgent: Request of Copy of ITR (BIR Form 2316).

Response to your request

In reply, we would like to inform you that your request for a copy of your BIR Form 2316 can’t be processed yet because BIR Form 2316 for the Taxable Year 2022 are only to be submitted  by your employer to the Revenue District Office (RDO) on February 28, 2023.

If you wish to have a copy of your latest BIR Form 2316 for the year 2022, kindly coordinate with your employer, they are supposed to provide you a copy of your BIR Form 2316 for taxable Year 2022.

It is also given an emphasis per Section 12. Section 2.83.1 of RR No. 2-98, as amended, is hereby further amended to read as follows:

“SECTION 2.83.1. Employees Withholding Statements (BIR Form 2316). –– In general, every employer or other person who is required to deduct and withhold the tax on compensation, including fringe benefits given to rank and file employees, shall furnish every employee from whom taxes were withheld a Certificate of Compensation Payment and Tax Withheld (BIR Form No. 2316) on or before January 31 of the succeeding calendar year, or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made.
