Hi, I would like to request if I may secure a copy of my filed BIR form 2316 by my previous employer for the covered year of 2022 for the purpose of complying with my employment requirements.

Thank you for your request dated Mar 25, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Requesting for BIR Form 2316 CY2022.

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as your ITR for CY 2022 is yet to be filed on or before April 15 next year, hence, your request is denied.

However, if you need this requirement for employment purposes, you may just directly request the BIR Form 2316 from your previous employer as they are the main source of this document and it is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.
