Hi! I would like to request information regarding my ITR/BIR 2316 for the period stated above. My employer did not provide me a copy at the time and I can't contact them anymore. Hopefully I can have a copy through this request. Thank you.

Dear Ms. Clemente:

Greetings!

Thank you for your request dated Sep 13, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for BIR Form No. 2316 and/or Income Tax Return.

Response to your request

In reply, please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year 2018 to 2019 cannot be granted/provided by the Revenue District Office (RDO) where your employer during the CY period is/are registered because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
