Good day!

I would like to request a copy of my BIR Form 2316. I am required by my new employer to submit a copy of this form in order for me to receive my salary.

Dear Mr. Adonay,

I refer to my letter of Oct. 07, 2021, 12:06:53 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.

Kindly clarify from your new employer if what they are asking from you is the past years as maybe what they were asking from you is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment (2021)and your tax liability will be based on your total income for the year.

Furthermore, please be informed that your BIR Form 2316 should have been issued to you by your previous employer, If there is any, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made.

It is advised that you better ask for a copy of your 2316 directly from your employer as they are the main source of such document.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 31, 2021, 04:24:45 AM, your request will be closed.
