Dear Sarah May Gonzales,

I refer to my letter of Aug 24, 2022 10:23:14 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Latest Income Tax Return (ITR).

In reply, we refer you to Section 6 of Revenue Regulations (RR) 10-2008 wherein EMPLOYER/S are required to furnish every employee from whose compensation taxes have been withheld BIR Form 2316 Certificate of Compensation Payment/Tax Withheld on or before January 31 of the succeeding year or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made.  Failure to furnish the same shall be a ground for the mandatory audit of payor's income tax liabilities (including withholding tax) upon verified complaint of the payee.

Hence, we suggest that you coordinate with your EMPLOYER (For the issuance of BIR Form 2316 for Taxable Year-2021) as they are the ones who prepare your BIR Form 2316 Certificate of Income and Tax Withheld and issue the same to their employees.

We called your mobile number a couple of times and even sent an email last September 1, 2022 to validate your existing Income Tax Request (ITR) Request but was unsuccessful and we did not received any response from you. 

We thereby assume that you are not anymore interested to pursue the same and will be cancelling or closing it for the time being.
