Dear Sir/Madam,

Hope you are doing well.

I am writing in through this website to request and hopefully receive the latest copy of my BIR 2316 form. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not responding to my email and request I worked from April 2012 to February 2013.

It would be very much appreciated if you can send me a copy via email as my employment is on the line — I have to submit this on until October 2nd.

Greetings!

Thank you for your request dated Sep 25, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Latest 2316.

Response to your request

Please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year 2012 to 2013 cannot be granted by the Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
