Thank you for your request dated Oct 19, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.
We received your request on Oct 19, 2022 and will respond on or before Nov 09, 2022 12:34:45 PM, in accordance with the Executive Order's implementing rules and regulations.
Please be informed, that your request for a copies of your BIR Form 2316 for the calendar year 2010 to 2014 cannot be granted by the Revenue District Office concerned since the aforesaid Certificates of Withholding Taxes were issued in 2010 to 2014 and records on those periods are already unavailable since the Bureau follow strictly the five (5) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).
What can be provided to you is your request for a copies of BIR Form 2316 for Calendar Year 2015 and 2016 if your employer has submitted their records.

December is more than a month and we need the document, please. Is there any other way to request the documents for a faster response? I checked eFOI 2316 requests and most were provided in less than a week.

While our aim is to provide information whenever possible, in this instance this Office does not have all the information you have requested. Our records show that your employer is non-compliant on the submission of the 2316 of their employees.
