Dear Ms. Roque:

I refer to my letter of Oct 08, 2023 06:48:06 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for INCOME TAX RETURN and/or BIR FORM NO. 2316.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period of October 2021 to October 2023? Or were you an Individual Earning on Purely Compensation Income from the period of October 2021 to October 2023?

2. Withstanding your answer to the first and second query, did you file an ITR for the cited period October 2021 to October 2023?

As an added note/reference, if you are an Employee for the period of October 2021 to October 2023, your EMPLOYER (s)  is/are required to issue a copy of your BIR Form 2316 for aforesaid years  pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer (s)  if you have not receive a copy of your BIR Form 2316 for Calendar Years 2021 to CY 2023 (in case your employment with the company has been terminated/ended before the end of this year).

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jan 01, 2024 07:59:29 AM, your request will be closed.
