Dear Sir/Madam,

Hope you are doing well.

I am writing in through this website to ask a legal action with regards to my BIR 2316 because my previous employer did not give my copy of BIR 2316 after the end of my contract with them. My contract ended last June 30, 2023 and I received my last compensation October 6, 2023. After that, I was employed to my present employer and I need to submit my previous BIR 2316 as part of requirements. And I requested my previous employer October 25, 2023 and until now they did not give my copy of BIR 2316.

Dear Mr. Hinampas:

I refer to my letter of Dec 27, 2023 04:55:36 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request Form -  BIR 2316.

In reply, please be informed that the BIR Form No. 2316 for Calendar Year 2023 has not yet been submitted by your Employer in the Revenue District Office (RDO), where your employer is registered, because the Taxable Period has not yet elapsed/finished. 

The RDO gets a hold of the said BIR Form 2316 upon submission of your previous employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2024.

However, you may wish to contact/coordinate with your previous employer for the issuance of your BIR Form No. 2316 for CY 2023 in case your employment with them has been terminated/ended per Section 6 of Revenue Regulations (RR) No. 10-2008 provides that it is the responsibility of the EMPLOYER to furnish the employee his/her BIR Form 2316 on or before January 31 of the succeeding calendar year, or if the employment is terminated before the close of such calendar year, on the day of which the last payment of compensation is made. Before resolving to filing a written complaint against your previous employer at the RDO where they are registered.
