Hi! I would like to request your good office for a copy of my BIR Form 2316 duly stamped by the BIR as "received" for the taxable years 2020, and 2021 (if already available). The purpose of which is for my application for a housing loan with Pag IBIG. In case the following are not available, can you provide me a set of procedures on how I can obtain this. I've read that employees can go to the BIR office and request such using a form. However, the form was not indicated.

I refer to my letter of Feb 03, 2022 07:18:34 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR-stamped Form 2316.

In order for us to properly endorse and work further on your request, we need more information from you regarding your query. Kindly provide us your employer’s TIN, RDO and business name & address  and email it at ana.marie.du@bir.gov.ph as these are sensitive information. Your 2316 for CY is yet to be file on or before April 15 this year hence we cannot provide you the same.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 29, 2022 03:28:18 AM, your request will be closed.

Greetings!

Thank you for your request dated Feb 03, 2022 07:18:34 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for BIR-stamped Form 2316.

Response to your request

While our aim is to provide information whenever possible, in this instance - BIR Form 2316 as per Revenue Regulations No. 11-2013, it is the employer who shall furnish their employees copy of BIR Form 2316 on or before January 31 of the succeeding calendar year, or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made. Failure to furnish the same shall be a ground for the mandatory audit of payor's income tax liabilities upon verified complaint of the payee. Said regulation may be downloaded at www.bir.gov.ph.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
