Hi!

I would like to request on how will I get a clarification from the BIR, or perhaps, a ruling on treatment on certain tax provision. Is there a form to fill out? Or I just need to send a letter to the BIR to seek ruling?

Response to Request

Please check Revenue Memorandum Order No. 9-2014 dated February 6, 2014 which provides for guidelines in the processing of requests for rulings/clarification with the Law and Legislative Division.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by complying Section 29 of the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, as published and circularized through Revenue Memorandum Circular No. 128-2019 dated November 29, 2019. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
