Dear Mr. De Guzman:

I refer to my letter of Nov 07, 2023 02:21:10 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316 for Calendar Year  2017 to 2023.

After careful consideration, we inquire from our system and you are registered as Local Employee, thus, you are to coordinate with your EMPLOYER (s) as the same is Mandated to Issue the BIR Form No. 2316 pursuant to Section 83 of the 1997 Tax Code and Section 2 [2.83.1] of Revenue Regulations (RR) No. 3-2002 for the Calendar Year (s) 2017 to 2023 (in case your employment with the company has been terminated before the end of the year).

Your EMPLOYER (s) shall furnish each Employee/s with the Original Copies of BIR Form No. 2316 as Proof that your Taxes were Withheld and this will serve as your Income Tax Return (ITR).  Your EMPLOYER (s) is required to issue BIR Form No. 2316 on or before January 31 of Every Year and On the Day the Last Payment of Compensation is Paid.     

As an added information, the available records of documents in the Revenue District Offices (RDOs) are from Calendar Year (s) 2020 to 2022.
