Dear Mr. Soon:

I refer to my letter of Sep 25, 2023 04:46:10 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period 2022 to 2023? Or were you an Individual Earning on Purely Compensation Income from the period 2022 to 2023?

2. Withstanding your answer to the first and second query, did you file an ITR for the cited period 2022 to 2023?

As an added note/reference, if you are an Employee for the period 2022 to 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for aforesaid year pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022 to 2023.

As to your other request for the Income Tax Return and/or BIR Form No. 2316 of your wife, please be informed that, if a request is through a representative, the written authorization (Special Power of Attorney) of the requesting party (wife) and 2 valid government IDs of the requesting party and the representative are needed.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 19, 2023 08:53:34 AM, your request will be closed.
