Hi! Good morning.

I would like to request for a softcopy of my 2020 BIR form no. 2316 as a request of my current employer for their yearend tax annualization. Hoping that you would grant my request. Thank you.

Dear Mr. Bandala,

I refer to my letter of Dec 04, 2021 09:16:18 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.

Kindly clarify from your employer if what they are asking from you is the BIR Form 2316 for the year 2020? Please be informed that your new employer shall supposedly ask you for the BIR Form 2316 for the current year, not the year 2020, for them to do the year-end adjustment for they will take into consideration your income from previous employment and your tax liability will be based on your total income for the year. Thus, we would like to advise that you better ask for a copy of your 2316 directly from your employer as they are the main source of such documents. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 28, 2022 03:30:04 AM, your request will be closed.
