Hi! I would like to request a copy of my BIR 2316 Form (Certificate of Compensation Payment/Tax Withheld) for the year 2021.

This is because it is one of the requirements needed by my new employer. I already requested a copy of my BIR 2316 to my previous employer but they’re not responding.

Thank you for your request dated Feb 28, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as your ITR  for 2021 and 2022 are yet to be filed on or before April 15 this year and next year, respectively. 

However, if you need this requirement for employment purposes, you may just directly request the BIR Form 2316 for CY 2021  from your previous employer as your new employer will take into consideration your income from your previous employment for them to do the year-end adjustment and your tax liability will be based on your total income for the year. 

It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.
