Dear Ms. Atienza:
I refer to my letter of Mar 30, 2023 04:44:25 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.
In order for us to work further in your request, kindly provide the (Complete) Name of your Employer/s, Employer’s TIN and Employer’s Registered Address for the period 2021 to 2022 and email the requested information at sherry.ann.arcita@bir.gov.ph and indicate in the email subject tracking number , #BIR-602426830679, to respond.
Please be informed, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2021 to 2022 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).
"BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jun 23, 2023 12:01:46 AM, your request will be closed.
