Dear Ms. Sta Rosa:

I refer to my letter of Nov 04, 2023 12:48:31 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR Certificate/ BIR 2316.

In reply, please be informed that your employer is obligated to furnish every employee's a copy of BIR Form No. 2316 as a proof of taxes withheld which shall serve as your Annual Income Tax Return per Revenue Regulation 2-98, as amended.

You may get in touch with them for the issuance of your Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) from your employer for the Calendar Year/s 2020 to 2021.

With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer. 

While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer (s)  is/are registered would take longer to provide you the information you have requested. They have to verify if your employer (s) has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jan 26, 2024 11:33:07 PM, your request will be closed.
