I'd like to request a copy of my ITR from my previous employer Transparent BPO Philippines. I have been working with TBPO from May of 2022-Feb of 2023.

Dear Ms. Orlanes:

I refer to my letter of Nov 10, 2023 12:31:19 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR TAX 2316 COPY.

In reply, please be informed that you may secure your Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) from your employer for the Calendar Year 2022 and 2023 (in case your employment with the company has been terminated/ended within the year).

BIR Form No. 2316 is a form issued by your employer (A Certificate). Hence, you may request for the issuance of the said documents to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.

With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer. 

While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer (s)  is/are registered would take longer to provide you the information you have requested. They have to verify if your employer (s) has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 02, 2024 12:39:13 AM, your request will be closed.

Hi Annita,

My previous employer already sent me a copy of my BIR 2316 at the time I received my last pay. It was sent to my email address but I no longer have access to it.  

I am from Cebu and my previous employer is in Taguig or in Manila. They only gave us a duplicate copy via email. My new employer asked me to secure a copy of my 2316 for this year's report 2023.

I have sent an email for a request but I haven't got any response. My previous RDO is registered in Cebu City. Please let me know what things I need to do to get this copy. I don't want to sign the waiver for my BIR tax.

Is this request offensive?
