Greetings.

Hope you are doing well.

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting it as a secondary document evidence of my employment to an overseas professional accreditation.
The companies I've worked with are as follows:
• P.A. Alvarez Builders Inc (Jan. 2013 - Dec. 2013)
• EEI Corporation (Nov. 2013 - Mar. 2015)
• Malabon City Government (Mar. 2015 - Dec. 2016)

The required report needs to cover all the duration spent in the said companies as proof of employment.

Dear Ms. valerio:

I refer to my letter of Dec 08, 2022 02:12:57 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, request for a copy of the Income Tax Return and/or BIR Form 2316 from your previous companies.

Please be informed that your request for a copies of your BIR Form 2316 for the Calendar Years 2013 to 2016 cannot be granted by the Revenue District Office (RDO) where your employer/s that period are duly registered since the aforesaid BIR Withholding Tax Certificates were issued in 2013 to 2016 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

For clarification, you may email sherry.ann.arcita@bir.gov.ph and indicate in the email subject ticket number #BIR-615489980873, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 07, 2023 12:40:06 AM, your request will be closed.
