Hi,

Good Day!

I am writing this email inquiry in connection with the aforementioned subject matter. 

The issue is this. My uncle (Mr. Paraguya) has a Parcel of land located in Imbayao, Malaybalay City. His land was surveyed by the DENR and what happened was DENR survey team committed an error resulting to an erronous survey. Subsequently, a Title was issued in favor of his neighbor.
Question.

1.) Is this subject to TAX?  Like donors, cgt, dst?
2.) This is reconveyance, returning to the rightful owner, is this really subject to tax?
3.) What is the legitimate action should Bir take?

in reply, please be informed that you may hire an attorney to file a petition to correct the technical description in the current title. Eventually, if the owner decided to sale and/or donate the property the transaction will be subjected to Capital Gains Tax (CGT) and Documentary Stamp Tax (DST) and/or Donors Tax (DT), depending on the   documents presented to the Revenue District Office (RDO).
