Hi! I would like to request a copy of my BIR 2316 Form (Certificate of Compensation Payment/Tax Withheld) for the year 2021.

This is because it is one of the requirements needed by my new employer. I already requested a copy of my BIR 2316 to my previous employer, but the copy I received was for the year 2020 and they said that they don't have my BIR 2316 for the year 2021.

My last day at my previous employer was June 15, 2021 and my start date at my new employer was last July 28, 2021.

Thank you for your request dated Sept. 29, 2021, under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for BIR 2316 (year 2021).

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as BIR Form 2316 for 2021 has yet to be filed on or before April 15 next year. However, if you have been employed for this year, you may request the BIR Form 2316 from your employer, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, if employment is terminated, on the day on which the last payment of compensation is made.
