I refer to my letter of Aug 01, 2022 11:39:19 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316 for calendar year 2021 specifically covering your employment with your employer for the period September 9, 2020 to May 10-2021.

Per initial evaluation from Internal Revenue Integrated System (IRIS) , it was found that your Taxpayer Identification Number (TIN) is registered under RDO52 – Parañaque City and  you are only registered as Executive Order No. 98-Filipino Citizen and not registered as a Local Employee;  You also submitted only one proof of identification with the eFOI requirement.

In addition, Section 6 of Revenue Regulations (RR) No. 10-2008 provides that it is the responsibility of the employer to furnish the employee his/her BIR Form 2316 on or before January 31 of the succeeding calendar year, or if the employment is terminated before the close of such calendar year, on the day of which the last payment of compensation is made. Our district office gets a hold of the said BIR Form 2316 upon submission of your employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year and should have been provided to you after it has been filed in the BIR. 

With the abovementioned regulation, since your employer, is mandated to furnish you a Certificate of Compensation Payment and Tax Withheld (BIR Form No. 2316) on or before January 31, each year of your employment, you may request your employer the copies of your BIR Form 2316 for your intended purpose.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 24, 2022 04:37:52 AM, your request will be closed.
