I would like to request a copy of my previous latest Income Tax Return. My contract with my previous employer has already been terminated since May 2023. I have received a letter regarding termination of my contract but I haven't received a copy of my BIR Form 2316.

Greetings!

Thank you for your request dated May 21, 2023 09:46:56 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Request of Copy of Income Tax Return and/or BIR Form No. 2316.

Response to your request

In reply, We regret to inform you that your request cannot be processed by Revenue District Office (RDO) No. 39-South Quezon City because your former employer did not submit scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2022.

For your concern, it would be best to directly request from your former employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.
