Hi! I would like to request for a copy of my BIR Income Tax Return from 2014-2017 to be used as proof of employment.

Greetings!

Thank you for your request dated May 09, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Request of copy of Income Tax Return (BIR Form 2316).

Response to your request

Please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year 2014 to 2018 cannot be granted by the Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

Your request can be obtained through your employer as they are obligated to furnish every employee a copy of the BIR Form 2316 as a proof of taxes withheld which shall serve as your  Annual Income Tax Return according to Revenue Regulation 2-98, as amended.
