Dear Mr.  Arilla:

I refer to my letter of Jun 08, 2023 04:10:37 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form No. 2316.

In reply, please be informed that your EMPLOYER is required to issue a copy of your BIR Form No. 2316 for Calendar Years 2022 to 2023 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Years 2022 to 2023. Per Revenue Memorandum Circular (RMC) No. 29-2019 All Taxpayers (including your employers) are required to preserve their accounting records for the period of 10 years.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Aug 31, 2023 08:27:30 AM, your request will be closed.
